These Epic Golf Travel Terms of Service (“Terms”) apply to your use of the Epic Golf Travel website located at https://epicgolftravel.com (“Site”) and the golf and vacation reservation services made available by Epic Golf Travel through the Site. The Site is operated by EpicGolf, LLC with its registered office address in Baltimore, Maryland USA. Epic Golf Travel makes reservations at golf courses and hotels around the world for Users through the Site, with this being referred to as the "Service".

1. Acceptance of the Terms

Please carefully read the following terms of use and all other rules and guidelines that we may communicate to you from time to time through the Service (collectively, the “Terms”), as these Terms create a binding legal contract between you and Epic Golf Travel. By accessing the Site, or availing yourself of the Service in any manner, you (“You” or “User”) agree that you have read, understood, and agree to be bound by and comply with the Terms. If at any time you do not agree to these Terms, you must immediately terminate your use of the Service.

These Terms and any other terms and policies incorporated herein by reference constitute the entire agreement between you and Epic Golf Travel pertaining to the subject matter hereof and supersede all prior agreements, understandings, negotiations and discussions whether oral or written. No waiver of any of the provisions of these Terms shall constitute a waiver of any other provision hereof (whether or not similar), nor shall any such waiver constitute a continuing waiver unless otherwise expressly provided by Epic Golf Travel.

The Site is offered and made available only to users eighteen (18) years of age or older. If you are not at least eighteen (18) years of age, please discontinue using the Site immediately, or if for any reason, you do not agree with all of the terms and conditions of these Terms, please discontinue using the Site immediately. By continuing to use or attempting to use the Site, you certify that you are at least eighteen (18) years of age.

If you are making a booking as a group, the leader of the group is responsible for sharing these Terms with all members of the group and is financially responsible for the booking. We will not be liable for a group leader’s failure to share these Terms with all travelers and participants in their group.

The information and features included in this Site have been compiled from a variety of sources, are for informational and entertainment purposes only and are subject to change at any time without notice. By accessing or linking to this Site, you assume the risk that the information on this Site may be incomplete, inaccurate, out of date, or may not meet your needs or requirements.

Your payment of a deposit or your retention of tickets, reservations or bookings after issuance shall constitute your consent to these Terms & Conditions.

2. Accuracy

Epic Golf Travel attempts to provide accurate descriptions of the products and services on the Site. Epic Golf Travel does not warrant, however, that the descriptions are accurate, complete, reliable, current or error-free. Therefore, Epic Golf Travel will confirm the details of your selected destination (including the costs and fees) at the time of booking.

3. Price and Payment

Epic Golf Travel reserves the right to alter the cost of any golf destination, not limited to any pricing error, and Epic Golf Travel will advise You of the current price of the golf destination prior to booking. Any subsequent reduction in costs due to special offers advertised will not apply to confirmed bookings.

Epic Golf Travel advertises a ‘from’ and ‘to’ pricing structure across parts of this website to indicate the approximate range in pricing across different times of the year. The ‘to’ price is based on the same room type as the advertised ‘from’ price. There will be occasional dates where pricing is over and above the ‘to’ price for a venue and the only available rate is the rack rate. Epic Golf Travel consultants will make You aware at the time of your inquiry that this may not be the best time to take your golf vacation.

After booking is confirmed, Epic Golf Travel may vary the price of your vacation solely to allow for variations in: (i) transportation costs including the cost of fuel, (ii) dues, taxes (including local taxes) or charges for services such as embarkation and disembarkation fees at ports and airports; and (iii) the exchange rate applied to your vacation. No price variation will be made less than 30 days before the start of your trip and Epic Golf Travel will absorb part of any increase in costs up to to 2% of the original net cost of your vacation.

The nature of travel involves risks and unpredictable weather. Epic Golf Travel cannot assure or promise any departure or arrival times at any point of an itinerary. Your right to receive a refund is limited. There will be no discounts or monies refunded for any missed or unused services. Although very rare, Epic Golf Travel reserves the right to cancel your trip for any reason. Should this occur, a full refund will be made to the paid traveler.

A minimum deposit of 25% must be paid at the time of booking. Epic Golf Travel reserves the right to request an additional deposit amount for certain bookings where our deposit amounts to our supplier are higher than usual. The balance of the price of your vacation must be paid no later than 60 days before the date your contracted vacation is due to commence (the “Balance Due Date”). Bookings made less than 60 days before the date the vacation is due to commence, must be paid in full at the time of booking. If the deposit, balance or final balance (as applicable) is not paid by the Balance Due Date, Epic Golf Travel reserves the right to cancel your booking and retain your deposit paid.

The cost of your accommodation does not include any services that you may use or purchase while at the accommodation other than those specifically included in the price of your vacation as set out in your booking confirmation. You must pay the hotel directly for such additional services. These may include spa treatments, purchases from pro shops and any meals and drinks not included in the price of your vacation.

While we do accept major credit cards including Visa, Mastercard, American Express and Discover, travelers must provide to us a click authorization for every transaction for your trip. Your authorization is an agreement for us to charge your card and an acknowledgement and agreement to these terms and conditions including the cancellation terms. As such you agree not to make any improper chargebacks.

In certain cases, cardholders can dispute charges with credit card companies ("chargebacks"). Before initiating a chargeback, we ask that you first call us to discuss any questions or concerns about our charges. We will work with you in attempting to resolve your concerns. By using our service to make a reservation, you accept and agree to our cancellation policy. Epic Golf Travel retains the right to dispute any chargeback that is improper and recover any costs, including attorney’s fees related to improper chargebacks. Additionally, in the event of an improper chargeback, we retain the right to cancel any travel reservation related to that improper chargeback. The following chargeback scenarios are improper, and we retain the right to investigate and rebut any such chargeback claims:

Chargebacks resulting from non-cancellable reservations, whether or not the reservation is used.
Chargebacks resulting from charges authorized by family, friends, associates or other third parties with direct access to your credit card. This does not include credit card fraud.
Chargebacks arising from inconsistency or inaccuracy with regard to the supplier’s product description.
Chargebacks resulting from force majeure or other circumstances that are beyond the control of Epic Golf Travel or the Supplier.
Chargebacks resulting because you do not agree with the cancellation policy.

4. Travel Insurance

Trip cancellation and interruption insurance, medical and hospital insurance, baggage insurance, and various additional insurances are available and HIGHLY RECOMMENDED. If you choose not to purchase insurance, you are fully liable for any and all penalties imposed as stated under paragraph 6, "Cancellations / Amendments By You", as well as any other terms and conditions contained in these Terms & Conditions. Please speak to your representative at the time of making reservations about travel insurance.

We consider adequate travel insurance to be essential and strongly encourage all our clients to purchase trip coverage. It is your responsibility to ensure that the insurance coverage you purchase is adequate for your particular needs. We do not check insurance policies. Please read your policy details carefully and take them with you on your vacation. We do not accept any liability for any possible loss that you suffer as a result of your failure to take out an adequate insurance policy.

5. COVID-19 Policies

If you have an existing booking that is due to take place soon and there are COVID-19 travel restrictions in place that prevent you from getting to or from your destination, or if your destination is fully closed due to COVID restrictions, here are your options:

  • You may change your destination or date of travel. You should speak with one of our team members to help move your trip to an alternative destination and/or date. We will do all we can to fit  your schedule to re-book your trip to a more appropriate time.
  • You may opt for a Future Travel Credit. If you are unsure of where or when to move your trip, we will offer you a full credit to your account in the form of a Future Travel Credit. This allows you to apply the full credit to your account to a future trip with Epic Golf Travel, with travel beginning no later than 24 months after your initial trip start date.

If COVID-19 is forcing closure of your chosen destinations lodging, golf or transportation, Epic Golf Travel will contact you to discuss the above options.

Please Note: Bookings unaffected by destination closures or travel restrictions due to COVID are still going ahead as planned. If you wish to cancel in this instance it will be deemed as a ‘disinclination’ to travel and our standard cancellation terms will apply (See paragraph 6 for full terms).

6. Cancellations / Amendments By You

If, once the booking confirmation has been issued, you wish to change the numbers of persons in your group booking, transfer your vacation to another person, or cancel your vacation, the person who originally booked the vacation (the lead name) must notify us in writing by email or posted mail.

While Epic Golf Travel will do its utmost to minimize any penalties charged by our suppliers for cancellations, there are irrecoverable costs to us associated with your tour. Cancellation penalties from our suppliers for tours will vary and there may be additional penalties associated with your tour.

Epic Golf Travel incurs costs with the suppliers of your trip well in advance of your departure date. All suppliers have their own cancellation policies, which apply to your booking. Because of this, we incur costs in cancelling confirmed bookings, particularly if cancellations occur close to the departure date, and in these circumstances, you will be charged a cancellation fee. If you cancel your vacation or the number in your group booking reduces before the Balance Due Date, we will retain the deposit paid by (or due from if still outstanding) each person cancelling as a cancellation fee. If you cancel on or after the Balance Due Date, we have the right to charge you a cancellation fee up to an amount equal to the balance of the price of your vacation.

If you have already paid your balance at the time of your cancellation, we have the right to retain the entire amount paid by you as a cancellation fee. Note that if the reason for your cancellation is covered under the terms of your personal travel insurance policy, you may be able to reclaim these charges.

As our prices are based on contract rates with suppliers, there are no refunds for any unused portion of a travel booking. If you cancel while your trip is in progress, there is no refund for the unused portion.

All trip amendments requested by you are subject to our sole discretion and may be subject to an additional fee which may increase the cost of the trip. In particular, if numbers change so that there is an odd number remaining in the party, single room supplements will apply.

7. Cancellations / Amendments By Us

Occasionally, we have to make changes to, and correct errors in, our brochures and on our website both before and after bookings have been confirmed, as well as cancel confirmed bookings. While we always endeavor to avoid changes and cancellations, we must reserve the right to do so.

In addition, if we have to make a significant change to or cancel your booking, we may pay you compensation, if appropriate. However, compensation will not be payable and no liability beyond offering the above-mentioned choices is accepted where we are forced to make a change or cancel as a result of force majeure (as defined in Section 18 below) or if we cancel as a result of your failure to comply with any requirement of these booking conditions entitling us to cancel (such as paying on time).

Golf clubs and golf courses may either close the golf course or operate temporary tees and greens at their sole discretion as a result of adverse weather conditions or golf course maintenance. We have no control over these closures or other temporary policies that are enforced by golf clubs or golf courses and are therefore not responsible financially or in any other way for these policies.

8. Tour Revisions By You

Changes to your tour reservation might not be possible after your reservations are initially made. Should you request a change and we are able to accommodate it, you will be subject to any charges imposed by the tour suppliers. In addition, we reserve the right to charge a $250.00 USD revision fee for each individual and separate change request made after the deposit is paid.

9. Tour Changes By Us

We reserve the right to substitute itineraries, hotels, airlines, golf courses or transportation due to conditions beyond our control. In such cases we will do everything possible to ensure the locations visited, the excursions taken and the hotels and golf courses offered are similar to the ones originally planned. Any change to itineraries will not result in eligibility for a refund.

10. Increase in Tour Cost

Epic Golf Travel reserves the right to increase tour prices in the event of an increase in government and airport authority imposed taxes and fees, fuel and currency surcharges, supplier price increases, or any other cost increase. If the increase is greater than 5% of the tour cost, the client may cancel the booking within 7 days of notification and obtain a full refund.

11. Complaints During Your Vacation

If you have a complaint or experience any problems during your vacation please inform the hotel or supplier concerned as soon as possible. If the matter cannot be resolved locally with the supplier at the time, you must notify us via email at admin@epicgolftravel.com giving all relevant information within 24 hours of any complaint or problem. If you fail to follow this procedure, we will have been deprived of the opportunity to investigate and rectify your complaint while you were on your golf trip and this may affect your rights under this contract.

12. Special Requests and Medical Problems

If you have any special requests, you must advise us at the time of booking. Although we will endeavor to pass any reasonable requests on to the relevant supplier, we regret we cannot guarantee any request will be met. Confirmation that a special request has been noted or passed on to the supplier or the inclusion of the special request on your confirmation or any other documentation is not confirmation that the request will be met. Unless and until specifically confirmed, all special requests are subject to availability.

If you or any member of your party has any medical problem or disability that may require assistance, it is your responsibility to tell us before you book or if diagnosed after you confirm your booking as soon as possible after you become aware. If the supplier in question reasonably feels unable to properly accommodate the particular needs of the person concerned, we must reserve the right to decline your booking or, if full details are not given at the time of booking, cancel when we become aware of these details.

13. Passports and Visas

All passengers traveling internationally must travel with a passport. Many countries require the passport to be valid for 6 months beyond the traveler’s return date. Visas may be required for some destinations. It is the passenger’s responsibility to obtain at the passenger’s expense, all documentation required by all relevant authorities. In the event that the passenger does not possess the correct documentation, the air carrier has the right to refuse passage. It is your responsibility to ensure that you have the correct travel documentation for your destination and we do not accept any liability if you are refused transportation by any carrier or entry into any country due to your failure to carry correct documentation.

Travel to certain destinations may involve greater risk than others. Epic Golf Travel urges Travelers to remain informed daily as to current news, as well as to review travel prohibitions, warnings, announcements, and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to destinations can be found at http://www.state.gov, and http://www.cdc.gov. In addition, you should consult with government websites to ensure that you are following all requirements for admittance into that country, including COVID- 19 requirements, as well as understanding local laws that govern travel within a country, such as medical tests and tracking. Should you choose to travel to a country that has been issued a travel warning or advisory, Epic Golf Travel will not be liable for damages or losses that result from travel to such destinations.

14. Delays

We cannot accept liability for any delays due to arrangements you make for air travel or any other transportation not booked with us.

15. Ownership; Proprietary Rights

The Site is owned and operated by Epic Golf Travel. The visual interfaces, graphics, design, compilation, information, computer code, products, software (including any downloadable software), services, and all other elements of the Site provided by Epic Golf Travel ("Epic Golf Travel Content") are protected by United States copyright, trade dress, patent, and trademark laws, international conventions, and all other relevant intellectual property and proprietary rights, and applicable laws. All Epic Golf Travel Content contained on the Site is the copyrighted property of Epic Golf Travel and/or third parties. All trademarks, service marks, and trade names are proprietary to Epic Golf Travel or its affiliates and/or third parties. You agree not to sell, license, distribute, copy, modify, publicly perform or display, transmit, publish, edit, adapt, create derivative works from, or otherwise make unauthorized use of the Epic Golf Travel Content, and nothing herein shall be interpreted to grant you any right or license under any intellectual property rights of Epic Golf Travel or any third party.

16. User Content and our Intellectual Property Policy

The Service may currently or may in the future allow you and other users to submit, post, and share content such as reviews, restaurant lists, messages, commentary or any other content (“User Content”). Any such User Content must not be illegal, threatening, obscene, racist, defamatory, libelous, pornographic, infringing of intellectual property rights, promoting of illegal activity or harm to groups and/or individuals, invasive of privacy, purposely false or otherwise injurious to third parties, or objectionable and must not consist of or contain software, computer viruses, commercial solicitation, political campaigning, chain letters, mass mailings, any form of “spam” or references to illegal activity, malpractice, purposeful overcharging, false advertising, or health code violations (e.g., foreign objects in food, food poisoning, etc.). You may not use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of User Content. Epic Golf Travel reserves the right (but has no obligation) to monitor, remove or edit User Content in Epic Golf Travel’s sole discretion, including if User Content violates these Terms (including any Epic Golf Travel Policies), but you acknowledge that Epic Golf Travel may not regularly review submitted User Content. If you do submit User Content, and unless we indicate otherwise, you grant Epic Golf Travel a nonexclusive, perpetual, royalty-free, irrevocable, and fully sublicensable (through multiple tiers) right to use, modify, reproduce, adapt, translate, publish, create derivative works from, distribute, display, and otherwise exploit such User Content throughout the world in any media. Epic Golf Travel takes no responsibility and assumes no liability for any User Content submitted by you or any other User or third party.

17. Prohibited Use Of The Service

The Service offered by Epic Golf Travel is strictly for your personal use. You also agree not to use the Service for any unlawful purpose or in any way that might harm, damage, or disparage any other party. Without limiting the proceeding sentence, you agree that you will not, whether through the Service, your User Content, or otherwise, do or attempt to:

  • Undertake, cause, permit or authorize the modification, creation of derivative works, translation, reverse engineering, decompiling, disassembling or hacking of the Site, Epic Golf Travel Content, User Content, or any other part thereof, except and solely to the extent permitted by law, or otherwise attempt to use or access any of the Service other than as intended;
  • Reproduce, duplicate, copy, sell, trade, resell, distribute or exploit, any part of the Service, use of the Service, access to the Site, or content obtained through the Service (including without limitation Epic Golf Travel Content, User Content, and Third Party Content (as defined below)), for any purpose other than for your personal, noncommercial purposes, except and solely to the extent permitted by these Terms;
  • Remove, circumvent, disable, damage or otherwise interfere with any security-related features of the Service, features that prevent or restrict the use or copying of any part of the Service, or features that enforce limitations on the use of the Service or any content therein;
  • Bypass our robot exclusion headers or other measures we may use to prevent or restrict access to the Service;
  • Use any robot, spider, scraper, or other automated means of any kind to access or scrape the Service, except as expressly authorized by Epic Golf Travel;
  • Frame or otherwise enclose any Epic Golf Travel trademark or any portion of the Service in any other site or service for any purpose without our express written permission;
  • Threaten, harass, abuse, slander, defame or otherwise violate the legal rights (such as rights of privacy and publicity) of others;
  • Publish, distribute or disseminate any inappropriate, profane, vulgar, defamatory, infringing, obscene, tortious, indecent, unlawful, offensive, immoral or otherwise objectionable material or information;
  • Create a false identity or impersonate another for the purpose of misleading others as to the identity of the sender or the origin of a message, including, but not limited to, providing misleading information in any reviews or to any feedback or rating system employed through the Service;
  • Transmit or upload any material that contains viruses, Trojan horses, worms, time bombs, cancelbots, or any other harmful or deleterious software programs;
  • Interfere with or disrupt the Service, networks or servers connected to the Service, or violate the regulations, policies or procedures of such networks or servers;
  • Upload or otherwise transmit any information or content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party, including by incorporating any such material in your User Content, whether by posting such material to the Site or otherwise; or
  • Use the Site in any manner whatsoever that could lead to a violation of any federal, state or local laws, rules or regulations, or the rights of any third party.

18. Social Media Services

The Service may currently or in the future offer features designed to help you share information with others, including in whole or in part based on your location or through social networks. These features are strictly offered on an “opt-in” basis and no disclosure of such information will be made without your consent. If you use certain features of the Service enabling you to share information with others using Facebook, Twitter, Google+, or other third party sites (each a “Social Networking Site”), you authorize Epic Golf Travel to share that information with the Social Networking Site. If you have any questions on how the Social Networking Site may use your information, please review their policies.

19. Modification of the Terms

Epic Golf Travel reserves the right to update or modify the Terms at any time without prior notice, and such changes will be effective immediately upon being posted through the Service. Your use of any Service following any such change constitutes your agreement to be bound by the modified Terms of Use. In the case of material changes to the Terms, Epic Golf Travel will make reasonable efforts to notify you of the change, such as through sending an email to any address you may have used to register for an account, through a pop-up window on the Site, or other similar mechanism. Material changes to these Terms will be effective upon the earlier of (i) your first use of the Service with actual notice of such change, or (ii) 30 days from posting of such change. Disputes arising under these Terms will be resolved in accordance with the version of the Terms in place at the time the dispute arose. We encourage you to review these Terms frequently to stay informed of the latest modifications.

20. Third Party Content and Links

The Service may contain references or links to third-party materials and services not controlled by Epic Golf Travel or its suppliers or licensors. Epic Golf Travel provides such information and links as a convenience to you and should not be considered endorsements or recommendations of such sites or any content, products or information offered on such sites. You acknowledge and agree that Epic Golf Travel is not responsible for any aspect of the information or content contained in any third party materials or on any third party sites accessible or linked from the Service.

21. Assumption of Risk

Traveler is aware that travel, such as traveler is undertaking on the trip, may involve inherent risks, including risks associated with sport. Inherent risks include, but are not limited to, risk of injury or death from: motor vehicles collisions, animals, roadway hazards, slips, and falls, criminal or terrorist acts, government actions, accidents on golf courses, consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements, including heat, cold, sun, water, and wind; your own negligence and/or the negligence of others, including other travelers, Epic Golf Travel and its employees, agents and/or representatives; attack by or encounter with insects, reptiles, and/or animals; accidents or illness occurring in remote places where there are no available medical services; fatigue, chill, overheating, and/or dizziness; known or unknown medical conditions, physical exertion for which you are not prepared or other such accidents; the negligence or lack of adequate training of any third-party providers who seek to assist with medical or other help either before or after injuries have occurred; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; and the adequacy of medical attention once provided.

Traveler understands the description of these risks, is not complete and that unknown or unanticipated risks may result in injury, illness, or death. In order to partake of the enjoyment and excitement of this trip, traveler is willing to accept the risks and uncertainty involved as being an integral part of travel, including the risk of infection, illness, and death. Traveler hereby accepts and assumes full responsibility for any and all risks of illness, injury or death and of the negligence of Epic Golf Travel and agrees to and shall hold harmless and fully release Epic Golf Travel, its owners, members, agents, and assigns (together Epic Golf Travel) from any and all claims associated with the trip, including any claims of third party negligence and/or the negligence of Epic Golf Travel and traveler hereby covenant not to sue Epic Golf Travel for any such claims or join any lawsuit or action that is suing Epic Golf Travel. This agreement also binds your heirs, legal representatives, and assigns. The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise.

22. COVID-19 Release

By booking a vacation at this time, you acknowledge the highly contagious nature of COVID-19 and voluntarily assume the risk for yourself and any minors traveling with you, that you or they may be exposed to or infected by COVID-19 by traveling and that such exposure or infection may result in personal injury, illness, permanent disability, and death even if such injuries or losses occur in a manner that is not foreseeable at the time you book your vacation. You acknowledge that exposure to such viruses or disease is an inherent risk of traveling, that cannot be controlled or eliminated by Epic Golf Travel.

You acknowledge that due to the uncertainty of travel, your vacation may be postponed or cancelled, or changes may be made to itineraries due to closures of certain sites or activities, for which there may be no refund. You may also be required to quarantine upon arrival in some locations. Some locations may require you to have a vaccination or proof of negative testing. Stopover countries requirements will also apply. On your return home, additional testing, requirements, or documentation may be required. You are responsible for understanding these requirements and must not rely on Epic Golf Travel to provide these details. You understand that you may become sick before, during, or after the vacation and may not be able to travel and such cancellation or interruption will be subject to our cancellation terms, for which we will not be liable.

You agree that due to uncertainty caused by COVID-19, Epic Golf Travel has strongly encouraged the purchase of travel protection coverage including cancel for any reason coverage if and when available, and that should you fail to purchase travel protection coverage, Epic Golf Travel shall not be liable to any losses howsoever arising. Epic Golf Travel shall not be liable should your chosen travel protection fail to provide coverage for COVID-19 related injuries.

You, for yourself, and any minors traveling with you, and on behalf of your and their heirs, assigns, personal representatives and next of kin (The Releasors), HEREBY RELEASE, AND HOLD HARMLESS Epic Golf Travel, its members, officers, agents, and/or employees, and suppliers (RELEASEES), of from and against any and all claims, damages, demands, losses, and liability arising out of or related in any way, in whole or in part to any POSTPONEMENT, CANCELLATION, CHANGES, INJURY, DISABILITY, DEATH OR ANY OTHER LOSS you may suffer due to exposure, infection, spread, closure, and travel restrictions related to COVID- 19, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law. The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise.

23. Indemnification

Each traveler is expected to act responsibly and adhere to all behavior guidelines established by Epic Golf Travel or our local suppliers. Our local suppliers reserve the right to remove you from any trip if you endanger yourself or others or disrupt others. In any such case, there will be no refund.

Traveler agrees to and shall indemnify and hold harmless Epic Golf Travel, and each of our officers, directors, employees and agents (collectively “Epic Golf Travel”), from any expenses, losses, liabilities, damages, judgments, settlements and costs (collectively, “damages”) involved with or incurred by Epic Golf Travel (including, without limitation, reasonable attorneys’ fees and the advancement of same) with respect to any claims, law suits, arbitrations, or other causes of action, which result, directly or indirectly, from: (i) traveler’s breach or violation, or threatened breach or violation, of this Agreement and (ii) Any damage caused by traveler while participating in the trip.

The lead name on each booking with Epic Golf Travel is responsible for the actions of their group while on vacation, and may be liable for any costs incurred for the negligence or misconduct of their group.

25. Limitation of Liability


We exercise no control over our Third Party Providers and cannot be held responsible for the failure of these providers to carry out any obligations. Any and all bookings made with these providers by us, for you, are subject to the terms and conditions of each and every such provider.

Provider liability may also be limited by law, tariffs, or conditions set forth in their documentation, tickets, etc. Without limiting the generality of the foregoing, Epic Golf Travel and its directors, officers, employees, affiliates, successors, assigns, agents and other representatives are not responsible for any and all claims for losses, damages (whether direct, indirect, special, punitive, or other consequential damages, lost profits or opportunities) delays, illness, injuries, inconvenience, loss of enjoyment, or anxiety (whether based in contract, tort, negligence, strict liability or otherwise, and even if Epic Golf Travel and the Third Party Providers have been advised of the possibility of damages to such party or any other party) arising from:

  1. Fault or negligence or omissions on the part of the Third Party Provider;
  2. Illness, theft, strikes, mechanical problems, quarantine, governmental intervention, weather conditions, acts of hostility or violence, and any other grounds beyond our control;
  3. Your failure to obtain passport, visas, other travel documents or inoculations
  4. Your failure to advise us the name of the traveler exactly as it appears on the passport;
  5. Your failure to report on time at an airport or ground transfer facility;
  6. Material damages, theft or other mysterious disappearances of your goods;
  7. Personal injuries or death;
  8. Force Majeure – an event(s) beyond our, or our Third Party Provider (s)’, reasonable control including, but not limited to, acts of God, strikes, lockout or other labour disputes or disruptions, wars, blockades, epidemics, pandemics, insurrections, riots, earthquakes, weather conditions, floods or acts of restraints imposed by governmental authorities.

26. Governing Law / Jurisdiction / Class Action Waiver / Notice

This Agreement and all attachments hereto and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the State of Maryland exclusive of conflict or choice of law rules. Any claims shall be brought in a court of competent jurisdiction located in Maryland. You agree that you will only bring claims against Epic Golf Travel in your individual capacity and not as a plaintiff or class member in and purported class action or representative proceeding. Epic Golf Travel shall not in any case be liable for other than compensatory damages, and your payment of a deposit on a trip means that you agree to these conditions of sale and expressly waive any right to punitive damages. You understand and agree that no claims will be considered and that you will not bring suit against Epic Golf Travel unless you have first provided a typewritten notice of claim to Epic Golf Travel within 30 days after the vacation or cancellation of the trip.

27. Force Majeure

In these Terms, “force majeure” means an event which we could not reasonably foresee and is beyond the control of Epic Golf Travel. Such events may include, without limitation, war or threat of war, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire, epidemics and pandemics and all similar events outside our control.

28. Notices

Epic Golf Travel may provide you with notices by mail, electronic mail, or postings on the Service. You may provide Epic Golf Travel with notices by United States Registered Mail sent to Epic Golf Travel, P.O. Box 42685, Towson, Maryland USA 21284. If notice is provided by electronic mail, notice will be deemed given twenty-four hours after electronic mail is sent, unless Epic Golf Travel is notified that the electronic mail address is invalid. If notice is provided by posting through the Service, then notice will be deemed given upon such posting. Alternatively, we may give you legal notice by mail to a postal address, if provided by you through the Service. In such case, notice will be deemed given three days after the date of mailing.

29. Miscellaneous

This is the entire agreement between you and Epic Golf Travel relating to the subject matter herein, and supersedes all previous communications, representations, understandings and agreements, either oral or written, between you and Epic Golf Travel with respect to said subject matter. These Terms shall not be modified or waived except in a writing signed by both parties, or by a change to these Terms as provided in Section 11 (“Modification of the Terms”), above. In the event any of the provisions of these Terms are held unenforceable or invalid by a court of competent jurisdiction, such provisions shall be deemed severed, and the remaining provisions thereof shall remain in full force and effect. The failure of Epic Golf Travel to enforce, in any one or more instances, any of the provisions herein shall not be construed as a waiver of the prior or future performance of any such terms or conditions. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Epic Golf Travel as a result of these Terms or use of the Service. You further acknowledge that by submitting User Content, no confidential, fiduciary, contractually implied, or other relationship is created between you and Epic Golf Travel other than pursuant to these Terms. The Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Epic Golf Travel without restriction, including by operation of law, merger, reincorporation, recapitalization, or sale of all or substantially all of the assets to which this agreement pertains. Any assignment attempted to be made in violation of these Terms shall be void. The headings and captions in these Terms are used for convenience only and are not to be considered in interpreting these Terms.
